What's Wrong With ObamaCare?

President Obama has put an import duty on tires made in China reportedly in an effort to gain necessary support to get his health care measures passed. Now if that is not selling one's soul and one's country to the devil for something President Obama and his handlers want, then nothing does. It is devilish because trade wars are beyond horrible for any country. Obama starting a trade war with our banker is so horrible the actions causes me to question Obama's loyalty to America. Does Obama want what is best for the United States or does he hate the United States and want it destroyed? Because starting a trade war with China is a great way to destroy the USA. Another act which causes me to question President Obama's loyalty and respect for the USA occurred when Obama allowed a skate boarder skate in the White House. This is not to say most skateboarders are not respectful, but skateboarding in respected places can be a sign of disrespect.

Anyway this article is about Obamacare health care. As I am a self insured 63 year old, the health care bill is of importance to me. Until my wonderful doctor, Bob Hutchins, who recently died, did his magic and prescribed me mostly $4 Walmart prescriptions, my scheduled blood pressure and cholesterol medication was costing me $350.00 per month. There was no way I could afford them, so I did what millions Americans who can't afford their prescriptions do, did not take them as prescribed. As hard as I have tried, this health care mess has been very hard for me to understand, and I make a science out of researching things. My research has been coming up with fine print red flags which is getting basically no media attention. An article sent me written by a retired Louisiana lawyer who now teaches a college course on US Constitutional law honed in what has been troubling me about Obamacare. Needless-to-say I was excited to read his article. The problems with Obama care is that the bill forces us to spend our money to purchase a health insurance policy and fines us if we do not. The bill gives the government the power to access our medical and financial records and forces us all, since we all will be required to have health insurance, to carry a federal identification card. What my brother in law Risher Randall and members of my family can't even come close to understanding is how hard I worked for my father to be able to buy a bunch of NBAN stock. Well when NBAN was destroyed I turned my back on banks and the financial system. My NBAN scars run very deep. The idea of the government having the power to get my financial records is reinforced by years of my hatred against Rothschild Rockefeller's Federal Reserve . A Federal Reserve which steals privately owned banks and gives them to the Rothschilds/Rockefellers, cowards to beat all cowards.

Of course I know the government accesses our/my financial records now. The government has also set in play illegal access and control the Internet. The government has already set in place illegal methods and systems to collect our DNA. The Red Cross is a major player in the government illegal collection of our DNA without the knowledge of or permission given by the people to the Red Cross to collect our their DNA. Our DNA is used to determine how the Rothschilds, Rockefellers and communi$t$ use us. Some of us they will just shoot in the head, others will be bureaucrats, others assassins, others this, that or the other, based upon our DNA. The point is that Obamacare and Jay Rockefeller's "Steal the Internet and give it to the government" bill are that the bills are for the purpose of legalizing government activity the government has been doing illegally for, in some cases, years.

Since health care is about forcing Americans to spend money where the communi$t$ want us to give them money, accessing our financial records, and ordering us to do what they want to order us to do, no health care bill will be Constitutional or beneficial. Logic dictates that President Obama really does not give a flip what health care bill is passed, as long as a health care bill passed has totalitarian legislation designed to shackle us more in it.

There is an aspect of this health care that I would like to weigh in on, since some have attacked it. Patients going to county supported Emergency rooms. God forbid, but if I did have to go to an Emergency Room for something acute, my county gives me payment plans and if I don't pay they take out liens liens on my stuff. The argument the county loses from providing emergency room health care really makes no sense to me. Many people pay for county provided emergency room services. The people who don't pay probably should get free health care. They are not going to pay under any health care system. My point of view for not being forced to buy a health care policy is also due to the fact my doctors have been very kind and offer me fantastic payment plans for the health care they provide. In my opinion and guess the payments I make to my doctors is much less than I would imagine I would pay for a government health care policy.

Our president is turning out to be a major con, as I have touted from day one. Just as I bad mouthed comrade Little George before it was cool to do so, ever since comrade Obama hit the radar I have said something is up with him. Like it or not, the United States is a very racist country. It made zero sense to me when comrade Obama first hit the scene and it makes no sense to me now that a racist country would really elect a minority president. Look at the number of minorities elected to office. Much less than their percent of the population. The bad guy communi$t$ behind the president who anoint the president to do their agenda, the Rothschilds and Rockefellers, are blatant racists, and if they anointed a minority president its because Obama being a minority helps bring their sinister plans into fruition. So what goes along with racism? Violence. So logic dictates the communi$t$ have anointed Obama president to bring violence to the United States. What the bad guys want, I don't. As fun as a gunfight might be, if the bad guys want violence, I don't.

PRESIDENT OBAMA’S HEALTH CARE SPEECH

Last night President Obama made what was touted by much of the media as a major address to Congress and the American people on healthcare. I’m not going to write a lengthy response to the speech because first, there was really nothing new in it, and secondly, he did not address the Constitutional issues. In fact, most of the health care bill supporters are running like mad from having to respond to questions from Americans on those issues.

Instead, they take the arrogant and elitist approach that the President took last night; accusing all who oppose the enlightened paternalism of the left of either being evil or just too dumb to know that we have to be taken care of by “Big Brother”. In other words, there was little in the speech that I have not already addressed in my previous articles posted here.

There is one issue that I need to address however, since not only have the President and members of Congress been making a point of it, but I have received several e-mails asking me about it. That is the question of whether illegal immigrants will get medical care under the provisions of HR 3200. My answer is clearly yes. This is disputed by those who point to Section 246 of the bill that is titled: “No Federal Payment for Undocumented Aliens”.

That seems clear enough, but what does it really say in the section. There is only one sentence in the section and it states:

“Nothing in this subtitle shall allow Federal payments for affordability credits on behalf of individuals who are not lawfully present in the United States.”

All that says is that affordability credits to help them get insurance are not available to illegals. It does not say that they can’t participate in the overall program and get reduced cost insurance under the so-called “public option”. Nor is there anything in the bill that requires someone to verify their citizenship to get benefits from the Insurance Exchange in the program. Any enforcement provisions were specifically excluded in the House Committee. The bill also doesn’t limit the care currently being provided for free at emergency rooms and government clinics. The access of illegal aliens to the system has been verified by a recent report released by the nonpartisan Congressional Research Service. This service works for Congress and the report was released days before President Obama made his speech, yet he continued to deny that illegals will get coverage. There is also a movement among some members of Congress to grant illegal immigrants full rights to participate in all government programs including Social Security, even if they have never paid a penny into the system.

Is it Constitutional to require American taxpayers to pay for medical coverage of those who have broken our country’s laws by sneaking across our borders? Nobody in the Obama Administration seems to care.

MORE ABOUT THE HEALTH CARE BILLS

How many times have we watched a movie about World War II and looked at the scene where a menacing Nazi soldier has stopped a citizen of an occupied country or even a German citizen and demanded to see the person’s “identity papers.” Failure to produce such papers would cause the person to be immediately arrested. I always felt good when I watched this because I knew that in my free country that couldn’t happen.

Yes, we have our driver’s license that you have to produce if you are stopped for a driving infraction and you may have to produce to write a check. However, if you choose not to drive you are not required to have one and you can get another form of identification to do something like cash a check. Yet, the fact is that you are not legally required to have either of these documents and if you do have them they can only contain a limited amount of information.

When I was practicing law I dealt with a situation where in the State of Louisiana you were required to provide your Social Security number to get a Driver’s License and it was also put on the license for everyone to see. I represented a client who had both privacy objections to this and religious objections. We won the case on the grounds that this requirement violated his constitutional rights. What made this particularly interesting was the fact that in support of our position I cited an opinion by a Court of Appeal Justice named Ruth Bader Ginsburg who is now one of the more liberal members of the Supreme Court.

Now, HB 3200 will mandate that everyone in the United States have a National Healthcare card that they will be required to produce to get medical treatment. This will be required whether they have private health insurance or are involved in the so-called public option. There are no real options, you must have this card and it can contain any information that the Obama administration requires. It will be the “identity papers” that so many totalitarian regimes are infamous for.

Of course, you may be thinking that this will no longer be a problem if the “public option” is removed from the bill. This has been a trial balloon floated by the Obama administration yet it really means nothing if the rest of the bill is adopted. The Congress will still be transferring unlimited power to the Executive Branch of Government and the Commissioner appointed by President Obama can still require a National Health Care identification card, still have access to your financial and medical records, and still fine you for having a plan unacceptable to the government. This will result in the ultimate destruction of private health insurance and the adoption of a public system of rationed health care totally controlled by the government.

I found it interesting that a week after I wrote my first blog questioning the constitutionality of House Bill 3200 Judge Andrew Napolitano on Fox News interviewed two Constitutional experts who also saw this as an unconstitutional action by the Congress. They pointed out that normally when this type of legislation is introduced in Congress the members of the House of Representatives or the Senate cite the provisions of the U.S. Constitution that authorize such legislation.

This has not been the case in any of the Health Care Bills proposed. This is not a simple oversight on the part of the Congress. They know they don’t have Constitutional authority to do this, but they simply don’t care. They intend to do it anyway. I find this to be both supremely arrogant, and absolutely terrifying. If they succeed in this, then no provisions of the Constitution are safe from attack.

In fact, in future articles I will point out where other provisions of our Constitution that I consider sacred are being totally disregarded and under full scale assault by the Congress and the Obama administration. I repeat what I said in my previous article; this is not about health care. It is about our fundamental rights as free citizens of the United States.

The Truth About the Health Care Bills

Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.

To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.

The Bill will also eventually force private insurance companies out of business and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled.

However, as scary as all of that it, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated. If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.

The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people and the businesses they own. The irony is that the Congress doesn’t have any authority to legislate in most of those areas to begin with. I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.

This legislation also provides for access by the appointees of the Obama administration of all of your personal healthcare information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a direct violation of the specific provisions of the 4th Amendment to the Constitution protecting against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.

If you decide not to have healthcare insurance or if you have private insurance that is not deemed “acceptable” to the “Health Choices Administrator” appointed by Obama there will be a tax imposed on you. It is called a “tax” instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn’t work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the “due process of law.

So, there are three of those pesky amendments that the far left hate so much out the original ten in the Bill of Rights that are effectively nullified by this law. It doesn’t stop there though. The 9th Amendment that provides: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;” The 10th Amendment states: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people.” Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.

I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights. Article 6 of the Constitution requires the members of both houses of Congress to “be bound by oath or affirmation” to support the Constitution. If I was a member of Congress I would not be able to vote for this legislation or anything like it without feeling I was violating that sacred oath or affirmation. If I voted for it anyway I would hope the American people would hold me accountable.
