DUBAI, United Arab Emirates - With oil prices above $70 a barrel fouling the world economy, dismay is focusing on Iraq, whose exports have slipped to their lowest levels since the 2003 invasion.

"Iraq could be making a tremendous difference," said Dalton Garis, an economist at the Petroleum Institute in Abu Dhabi. Instead, its shortfall is "a significant contributing factor to the high price of oil," he said.

Iraq, a founding member of OPEC, sits atop the world's third-highest proven reserves. Its estimated 115 billion barrels is more than any other OPEC member except for Saudi Arabia and Iran.

But contrary to optimistic expectations, Iraq's oil production has slipped further and further since the U.S.-led invasion.

Bush’s domestic wiretapping programme would be like the fight his colleague, John McCain, waged to prohibit the torture of detainees: a moment when the Republican-controlled Congress stood up to the White House.

But when the committee meets on Thursday, Mr Specter will face an uphill battle to get Republican support for his quest for more information about the National Security Agency’s surveillance programme.

Specter strikes NSA deal

Senate Judiciary Committee Chairman Arlen Specter (R-Pa.) and conservative members of his panel have reached agreement on legislation that may determine the legality of the National Security Agency’s (NSA) surveillance program, GOP sources say.

Specter has agreed to drop the requirement that the Bush administration seek a legal judgment on the program from a special court set up by the Foreign Intelligence Surveillance Act (FISA) of 1978.

Instead, Specter agreed to allow the administration to retain an important legal defense by allowing the court, which holds its hearings in secret, to review the program only by hearing a challenge from a plaintiff with legal standing, said a person familiar with the text of language agreed to by Specter and committee conservatives.

An expert in constitutional law and national security, however, said that the change would allow the administration to throw up huge obstacles to anyone seeking to challenge the program’s legality.

The agreement appears to pave the way for the committee to approve Specter’s bill and one sponsored by Sen. Mike DeWine (R-Ohio) granting the surveillance program legal authority.

Legal standing is a crucial question in every case heard before a federal court. Lawyers and legal experts widely acknowledge that a plaintiff cannot bring a case to a federal court if the plaintiff has not suffered damage.

In other words, individuals or groups that merely take an interest in a case, such as a privacy-rights advocacy group in the example of the surveillance program, cannot ask for a ruling from a federal court. Because the administration can use questions of standing and other tactics to keep plaintiffs out of court, the requirement that a plaintiff challenge the surveillance program — instead of mandating that the administration itself ask for a ruling on the program’s legality — gives the White House an important advantage.

Mary Cheh, a law professor at George Washington University who specializes in constitutional law, secrecy and national security, said that only allowing the judiciary to review a challenge to the surveillance program in response to a plaintiff’s challenge gives the administration legal cover.

Cheh said plaintiffs would likely have to jump over very high hurdles to have their cases heard. The administration could, for example, invoke the “state-secrets privilege” and deny plaintiffs access to information, or it could try to deny plaintiffs’ legal standing. Cheh said it would be difficult for plaintiffs to demonstrate in court that they have been injured by the surveillance program because the program is secret.

If plaintiffs are challenging the legality of evidence gathered against them through the NSA program, the administration could avoid a legal ruling on the program by dropping plans to use the controversial evidence or dropping the case.

But a GOP aide familiar with the compromise said more than 20 cases are “in the pipeline” in which plaintiffs have challenged the surveillance program. It was very likely that the court would rule on one of the cases if Specter’s bill passed, the aide added.

Cheh noted that administration lawyers could file a future motion to challenge any of the plaintiffs’ standing.

Republican Sens. Chuck Grassley (Iowa), Jon Kyl (Ariz.), Jeff Sessions (Ala.), John Cornyn (Texas) and Tom Coburn (Okla.) were said to have concerns about Specter’s bill. All are members of the Judiciary Committee, and their support is crucial to passing NSA-related legislation though the panel because Democrats say it is premature to pass a bill until more details of the surveillance program are known.

In a replay of the Iraqi weapons of mass destruction charade, neoconservative supporters of George W. Bush are pushing the U.S. intelligence community to take a more alarmist view about Iran’s nuclear program—only this time, the nation’s top spy John Negroponte is resisting the pressure unlike former CIA chief George Tenet.

“Our assessment is that the prospects of an Iranian weapon are still a number of years off, and probably into the next decade,” said Negroponte, who was appointed last year as the Director of National Intelligence, a new post that supplanted the traditional primacy of the CIA director as the head of the U.S. intelligence community.

In effect, the Director of National Intelligence was splashing cold water on the fevered assessment of Iran’s nuclear progress favored by the neoconservatives. Some Bush supporters are now complaining that Negroponte has shown disloyalty to the President by siding with intelligence analysts who reject the direst predictions on Iran.

If the Government Were No Up to Something Really Bad, They Would not Play the Magic Ring Card

When the government told a court Friday that it wanted a class-action lawsuit regarding the National Security Agency's eavesdropping on Americans dismissed, its lawyers wielded one of the most powerful legal tools available to the executive branch -- the state secrets privilege.

That privilege allows the government to tell a judge that a civil case may expose information detrimental to national security, and to ask that testimony or documents be hidden or a lawsuit dismissed.

In this case, the government will be asking a federal judge in California to dismiss a lawsuit filed by the Electronic Frontier Foundation against AT&T for its alleged complicity in warrantless government surveillance of its customer's internet and telephone communications. The EFF alleges that AT&T gave the government access to a massive phone billing database and helped the NSA spy on its customers' internet use.

But what exactly is the privilege, and how powerful is it?

The state secrets privilege cannot be found in the U.S. Code, the code of federal regulations or the Constitution. Instead, it is a part of common law, the body of laws and precedents created over centuries of legal decisions. When the government believes that a civil suit might reveal secrets injurious to the country, the head of the appropriate government agency must review the matter and submit a signed affidavit attesting to the danger of the lawsuit or documents that might be disclosed.

Judges almost invariably agree to such requests, according to William Weaver, a law professor and senior adviser to the National Security Whistleblowers Coalition.

"It's like one of magic rings from The Lord of the Rings," Weaver said. "You slip it on and you are invisible -- you are now secret.

Tobin's conviction is an embarrassment for Bush

A senior official in George Bush's re-election campaign has been sentenced to 10 months in prison for his role in suppressing votes in a US Senate race, a scandal that Democrats say may involve the White House.

James Tobin, 45, one of three Republican campaign operatives convicted in a phone-jamming scheme designed to keep New Hampshire Democrats from voting in a 2002 election, was convicted of two telephone harassment charges.

Prosecutors had asked for a two-year sentence.

Steven McAuliffe. a US district judge, described the crime as extremely serious and a threat to free and fair elections.

"People in your position need to know they cannot do these things and if they do the consequences are very, very serious," he said in handing down a sentence harsher than the six months home detention and community service sought by Tobin's lawyer.

Democrats want an investigation into 22 telephone calls made by Tobin and New Hampshire Republican party officials to the White House on November 5-6, 2002, and say they believe national Republican officials may be involved in the scheme .Kathleen Sullivan, the New Hampshire Democratic party chairperson, said she did not consider the sentencing to be the end of the matter.

"I consider this to be one more step in the process of uncovering exactly who knew about this. There are still unanswered questions," she said.

The national Republican party, which has paid more than $2.5 million in legal fees to defend Tobin, has said the calls to the White House were routine during a tight state Senate race and had nothing to do with the phone-jamming.

Get-out-the-vote hotlines set up by state Democrats and a firefighter's association to urge residents to vote were jammed by more than 800 hang-up calls. State Republican officials say they tried to stop it once they learned of the scheme.

John Sununu, the Republican candidate, beat Jeanne Shaheen, the then governor in the election and state Republicans swept a number of close polls.

Tobin, the former New England regional director of the Republican National Committee, stepped down as New England chairman of Bush's 2004 re-election campaign when he became subject of a federal criminal investigation.

Several other senior Republican figures have been convicted for their parts in the scheme.

Tobin was denied bail and also fined $10,000 and given two years of probation. He plans to appeal, his lawyers said.

Rumsfeld told members of the defense subcommittee of the Senate Appropriations Committee on May 17 that U.S. forces continue to find Iranian-manufactured weapons in Iraq, though he conceded that there is no conclusive proof of Iranian involvement.

If any country has interfered with the stability of Iraq it is the United States, not Iran. The United States attacked Iraq for no reason at all. Iraq had nothing to do with September 11. The United States has not declared war against Iraq. Because of the USA attacking Iraq Iraq's oil production has fallen to a trickle and the fact Iraq's oil is not being sold has contributed probably more than any one reason for the price of gasoline increasing from one dollar per gallon to over three dollars per gallon since Little George was anointed in 2000. The USA has destroyed Iraq's infrastructure and over 100,000 Iraq have been killed. The United States is responsible for the instability in the Mid East and not Iran. John Negroponte while Ambassador to Iraq set up death squads in Iraq which is responsible for sectarian violence in Iraq. It is insane for Rumsfeld to blame Iran for the trouble in Iraq and the Mid East when in fact the entire world knows it is a Neocon run United States which is responsible for the deaths and misery in the Mid East.

Rumsfeld was nonetheless clear in his conviction that it is in Iran's interest for Iraq to be weak.

"The thought of having the Iraqi constitution and the sovereign elected government fail there would be the best thing in the world from Iran's standpoint," Rumsfeld argued.

"If people are anxious to see Iran successful in the path they're on, it strikes me that that tossing in the towel on Iraq would be a boost" for Iran.

For example, the Alabama fires of both white and black congregations have grown from six churches burned down to nine.
