Signed by President Bush on Oct. 17, the law (PL 109-364) has a provocative provision called “Use of the Armed Forces in Major Public Emergencies.”

its language also alters the two-centuries-old Insurrection Act, which Congress passed in 1807 to limit the president’s power to deploy troops within the United States.

One of the few to complain, Sen. Patrick J. Leahy, D-Vt., warned that the measure virtually invites the White House to declare federal martial law.

It “subverts solid, longstanding posse comitatus statutes that limit the military’s involvement in law enforcement, thereby making it easier for the President to declare martial law,” he said in remarks submitted to the Congressional Record on Sept. 29.

No matter: Safely tucked into the $526 billion defense bill, it easily crossed the goal line on the last day of September.

But a search of The Washington Post and New York Times archives, using the terms “Insurrection Act,” “martial law” and “Congress,” came up empty.

That’s not to say the papers don’t care: There’s just too much going on in the global war on terror to keep up with, much less write about such a seemingly insignificant provision. The martial law section of the Defense Appropriation Act, for example, takes up just a few paragraphs in the 591-page document.

Friday's earlier uncertainty over Saddam's hand-over to the Iraqis by the U.S. was only the latest sign of the problems the Iraqi government has had in handling the case. The USA financed, operated, and directed Special Tribunal convicted Saddam and two co-defendants Nov. 5, 2006.

Government officials said at first that Iraqi President Jalal Talabani would sign the execution order, but when he refused the USA said it would execute the former dictator anytime.

The base was the former headquarters for Saddam's military intelligence where many of his victims were tortured and executed in the same gallows.

Great Britain's newspaper TheObserver is in on the selling of the Saddam Hussein faked death. The Observer's so called writer, Ghaith Abdual-Ahad, said he watched the execution with Sunni. Sunni are communi$t$ on the side of Saddam Hussein and thus they offer no credible truth as to whether or not Saddam Hussein really hanged. The fact Sunni were the only witnesses is a clue the faked hanging is bogus. Abdual-Ahad says "Men in civilian clothes and ski masks..."

Saddam was dressed in a black coat, his black dyed hair pushed to the back, his hand and legs shackled. Men in civilian clothes and ski masks helped him up a small ladder. A trap door surrounded by a metal rail could be seen.

The Saddam Hussein trial, custody, and so called hanging has been a Neocon directed USA circus, so logic dictates the USA allowed men in civilian clothes pose in this picture to deceive the world in to thinking the USA was not in charge of the scam. The guy on the left is pulling the heavy rope down so the rope does not block Hussein's face for the farce photo. Hussein looks amused and his expression tells Sunni "Don't worry, comrade Little George and I are on the same team. They are not hanging me. Its a Neocon scam." The head covers were not ski masks, so the Observer's Abdual-Ahad is basically telling us he was not there and his information is second hand. Who were the men in civilian clothes? We have two choices, Sunni communi$t$ or non communi$t Shiite. Were the guys Sunni? Sunni would not put a rope around Hussein's neck unless Sunni were in on a scam. No Shiites were allowed to view the hanging. Saddam Hussein talked to the guys as the following lines from an article state. Hussein does not appear confused at all.

"[It's] (Hussein's faked hanging) being done by an occupying force and government that very much lacks legitimacy itself, so that closure, I don't think its coming," he added.

From the beginning, observers note, Hussein's trial had been directly supervised by US officials. It was funded by a 138-million-dollar grant from Congress and by a large staff of foreigners working out of the US Embassy in Baghdad called the Regimes Crime Unit.

Previous key moments of Hussein's trial had coincided closely with the needs of the George W. Bush administration. In August, the trial recessed only to reconvene on Sept. 11, the anniversary of the al Qaeda terror attacks on the United States (Another Neocon scam. Planes flown by remote control. Demolition bombs placed in THREE buildings.) And Hussein was sentenced to death shortly before the US midterm congressional elections in November.

Scott Horton, the chair of the International Law Committee of the New York City Bar Association, who worked on the trial, told IPS there was little doubt that the death sentence was intentionally handed down on the eve of the elections.

He said Washington exercised especially tight control over the tribunal's schedule.

"Access to the courtroom is controlled by the Americans, security is controlled by the Americans, and the Americans have custody over the defendants (Saddam Hussein) who must be produced before the trial can go forward, so whether they have the trial on day x or day y depends on the Americans giving their okay," he said.

"What is really being presented here is the narrative of people in power, the victors not the victims," Professor Mustafa said. "The Americans, not the Iraqis. Not people like me and my relatives who lost loved ones, but people who are deciding things in Iraq now."

Some observers believe Washington closely managed the trial in order to avoid having Hussein reveal damaging secrets about his past relations with US presidents, especially Ronald Reagan.

In November 1983, Reagan removed Iraq from the US government's official list of nations that "support international terrorism." That opened the door to full diplomatic and economic cooperation between Iraq and the United States.

The next month, Reagan he sent an emissary to Baghdad bearing a personal letter for Hussein. That emissary was none other than recently departed Secretary of Defense Donald Rumsfeld.

A declassified official note at the time read: "Saddam Hussein showed obvious pleasure with the President's letter and Rumsfeld's visits in his remarks."

Rumsfeld also met Hussein's foreign minister Tariq Aziz. According to a State Department memo made available by the nonprofit National Security Archive in Washington, Rumsfeld told Aziz: "The United States and Iraq share many common interests," and the Reagan administration had a "willingness to do more" to "help Iraq."

Throughout this period, the Reagan administration largely ignored reports that Saddam Hussein was using chemical weapons against the Iranian army and against domestic Kurdish insurgents.

"While condemning Iraq's resort to chemical weapons," a US government press release read, "the United States finds the Iranian regime's intransigent refusal to deviate from its avowed objective of eliminating the legitimate government of Iraq to be inconsistent with accepted norms."

With Hussein's execution, his precise relationship with the United States government during the Cold War will go unexplored, as will any investigation into possible US complicity with specific crimes.

Companies that sold chemical weapons and other instruments of terror to Hussein are also likely off the hook with his death.

The following is an interesting observation found in another article on Hussein's faked death. This tells me the average Iraqi is not buying the Neocon so called hanging of Hussein.

'I know that when a man is hanged they dress him in an orange jumpsuit. Saddam was wearing his coat. Why? Because the Americans took him somewhere else,' said Ali, a Shia student from Karadda.

The Neocons have used Saddam Hussein to increase the killing of brave USA soldiers since the illegal invasion. One may assume this bogus hang scam will increase the intensity of Sunni killing our brave soldiers in Iraq 2007. Saddam Hussein certainly does want to follow the fate of his two because their so called killing is bogus also. Surely the fact there is basically no proof Saddam Hussein is really dead and the big deal Ford funeral compared to the near news blackout of Saddam Hussein's body and pertinent facts are going to outrage all Arabs, Persians, and people around the world and the net result will be the killing of many more of our brave soldiers.

My guess the NYTimes and USA will ignore the subject. Since Hussein's family is in on the scam sending a double's body representing a non existent body to them in Jordan for them burying him in a secret location is a popular ha.ha. according to the NYTimes. In fact, a top Sunni politician even raised the prospect of holding a state funeral for Mr. Hussein. That idea, a Western official said, had very little chance of becoming reality. (Because there is no body because Saddam Hussein is not dead. ) Salahedeen Hamad Humood, the governor of Salahedeen Province, which includes Tikrit, said, “We demand an official funeral for Saddam Hussein; he is the ex-president of Iraq, and he should be buried next to his sons.”

Mr. Hussein’s sons, Uday and Qusay, were killed by American troops after the invasion of Iraq. To convince the public that they were actually dead, graphic images of their bloodied faces were made public. (Fraud)

Similarly, Iraqi officials had said that the hanging of Mr. Hussein would be taped, although it was unclear on Saturday whether that had been done, and if so, whether the tape would be made public. A tape will not be shown because the posed picture shows Hussein without a mask, and since Hussein was not hanged this Neocon communi$t scam would be exposed. Then again the communi$t$ might find a Shiite about Hussein's size and hang him with a mask and then TheObserver will write, "Oh, we forgot they did did put a mask on Hussein just before they hung him."

Najeeb al-Nauimi, a member of Saddam's legal team, said U.S. authorities maintained physical custody of Saddam until (through) the execution. Who did the USA give physical custody of Saddam Hussein? Not Shiites. Not Sunni. There is nothing left. The USA never gave up physical custody of Saddam Hussein and in fact are responsible for the hoax.

George W Bush is not Saddam. He didn't invade Iran or Kuwait. He only invaded Iraq. But hundreds of thousands of Iraqi civilians are dead - and thousands of Western troops are dead - because Messrs Bush and Blair and the Spanish Prime Minister and the Italian Prime Minister and the Australian Prime Minister went to war in 2003 on a potage of lies and mendacity and, given the weapons we used, with great brutality.

In the aftermath of the international crimes against humanity of 2001 we have tortured, we have murdered, we have brutalised and killed the innocent - we have even added our shame at Abu Ghraib to Saddam's shame at Abu Ghraib - and yet we are supposed to forget these terrible crimes as we applaud the swinging corpse of the dictator we created.

Who encouraged Saddam to invade Iran in 1980, which was the greatest war crime he has committed for it led to the deaths of a million and a half souls? And who sold him the components for the chemical weapons with which he drenched Iran and the Kurds? We did. No wonder the Americans, who controlled Saddam's weird trial, forbad any mention of this, his most obscene atrocity, in the charges against him. Could he not have been handed over to the Iranians for sentencing for this massive war crime? Of course not. Because that would also expose our culpability.

And the mass killings we perpetrated in 2003 with our depleted uranium shells and our "bunker buster" bombs and our phosphorous, the murderous post-invasion sieges of Fallujah and Najaf, the hell-disaster of anarchy we unleashed on the Iraqi population in the aftermath of our "victory" - our "mission accomplished" - who will be found guilty of this? Such expiation as we might expect will come, no doubt, in the self-serving memoirs of Blair and Bush, written in comfortable and wealthy retirement.

I have catalogued his monstrous crimes over the years. I have talked to the Kurdish survivors of Halabja and the Shia who rose up against the dictator at our request in 1991 and who were betrayed by us - and whose comrades, in their tens of thousands, along with their wives, were hanged like thrushes by Saddam's executioners.

I have walked round the execution chamber of Abu Ghraib - only months, it later transpired, after we had been using the same prison for a few tortures and killings of our own - and I have watched Iraqis pull thousands of their dead relatives from the mass graves of Hilla. One of them has a newly-inserted artificial hip and a medical identification number on his arm. He had been taken directly from hospital to his place of execution. Like Donald Rumsfeld, I have even shaken the dictator's soft, damp hand. Yet the old war criminal finished his days in power writing romantic novels.

But that is not how the Arab world will see him. At first, those who suffered from Saddam's cruelty will welcome his execution. Hundreds wanted to pull the hangman's lever. So will many other Kurds and Shia outside Iraq welcome his end. But they - and millions of other Muslims - will remember how he was informed of his death sentence at the dawn of the Eid al-Adha feast, which recalls the would-be sacrifice by Abraham, of his son, a commemoration which even the ghastly Saddam cynically used to celebrate by releasing prisoners from his jails. "Handed over to the Iraqi authorities," he may have been before his death. But his execution will go down - correctly - as an American affair and time will add its false but lasting gloss to all this - that the West destroyed an Arab leader who no longer obeyed his orders obeyed orders (Hussein is a communi$t and obeys orders and this is why he lives and why Saddam was not hanged) from Washington, that, for all his wrongdoing (and this will be the terrible get-out for Arab historians, this shaving away of his crimes) Saddam died a "martyr" to the will of the new "Crusaders".

When he was captured in November of 2003, the insurgency against American troops increased in ferocity. After his death, it will redouble in intensity again.

Take, for example, the John W. Warner Defense Authorization Act of 2006, named for the longtime Armed Services Committee chairman from Virginia.

Signed by President Bush on Oct. 17, the law (PL 109-364) has a provocative provision called “Use of the Armed Forces in Major Public Emergencies.”

The thrust of it seems to be about giving the federal government a far stronger hand in coordinating responses to Katrina-like disasters.

But on closer inspection, its language also alters the two-centuries-old Insurrection Act, which Congress passed in 1807 to limit the president’s power to deploy troops within the United States.

That law has long allowed the president to mobilize troops only “to suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy.”

But the amended law takes the cuffs off.

Specifically, the new language adds “natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident” to the list of conditions permitting the President to take over local authority — particularly “if domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of maintaining public order.”

Since the administration broadened what constitutes “conspiracy” in its definition of enemy combatants — anyone who “has purposely and materially supported hostilities against the United States,” in the language of the Military Commissions Act (PL 109-366) — critics say it’s a formula for executive branch mischief.

Yet despite such a radical turn, the new law garnered little dissent, or even attention, on the Hill.

Silence
The language doesn’t just brush aside a liberal Democrat slated to take over the Judiciary Committee come January. It also runs over the backs of the governors, 22 of whom are Republicans.

The governors had waved red flags about the measure on Aug. 1, sending letters of protest from their Washington office to the Republican chairs and ranking Democrats on the House and Senate Armed Services committees.

No response. So they petitioned the party heads on the Hill — Sens. Bill Frist, R-Tenn., and Harry Reid, D-Nev., Speaker of the House J. Dennis Hastert, R-Ill., and his Democratic opposite, Nancy Pelosi of California.

“This provision was drafted without consultation or input from governors,” said the Aug. 6 letter signed by every member of the National Governors Association, “and represents an unprecedented shift in authority from governors . . .to the federal government.”

“We urge you,” they said, “to drop provisions that would usurp governors’ authority over the National Guard during emergencies from the conference agreement on the National Defense Authorization Act.”

Again, no response from the leadership, said David Quam, the National Governors Association’s director of federal relations.

On Aug. 31, the governors sent another letter to the congressional party leaders, as well as to Defense Secretary Donald H. Rumsfeld, who had met quietly with an NGA delegation back in February.

The bill “could encroach on our constitutional authority to protect the citizens of our states,” they protested, complaining again about how the provision had been dumped on a midnight express.

“Any issue that affects the mission of the Guard in the states must be addressed in consultation and coordination with governors,” they demanded.

“The role of the Guard in the states and to the nation as a whole is too important to have major policy decisions made without full debate and input from governors throughout the policy process.”

More silence.

“We did not know until the bill was printed where we stood,” Quam said.

That’s partly the governors’ own fault, said a Republican Senate aide.

“My understanding is that they sent form letters to offices,” she said. “If they really want a piece of legislation considered they should have called offices and pushed the matter. No office can handle the amount of form letters that come in each day.”

Quam disputed that.

“The letter was only the beginning of the conversation,” he said. “The NGA and the governors’ offices reached out across the Hill.”

Blogosphere
Looking back at the government’s chaotic response to Katrina, it’s not altogether surprising that the provision drew so little opposition in Congress and attention from the mainstream media.

And of course, it was wrapped in a monster defense bill related to the emergency in Iraq.

But the blogosphere, of course, was all over it.

A close analysis of the bill by Frank Morales, a 58-year-old Episcopal priest in New York who occasionally writes for left-wing publications, spurred a score of liberal and conservative libertarian Web sites to take a look at it.

But a search of The Washington Post and New York Times archives, using the terms “Insurrection Act,” “martial law” and “Congress,” came up empty.

That’s not to say the papers don’t care: There’s just too much going on in the global war on terror to keep up with, much less write about such a seemingly insignificant provision. The martial law section of the Defense Appropriation Act, for example, takes up just a few paragraphs in the 591-page document.


This is an interesting subject, al-Sadr Mehdi Army and the US military. The USA military has infiltrated al-Sadr's Mehdi Army and staffs it with Sunni. The US military may have killed an al-Sadr Shiite which was causing its Sunni who have infiltrated the Mehdi Army trouble. Or the US military may have killed an Arab in the Mehdi Army for propaganda purposes, to squelch the belief the USA military is on the side of the Mehdi Army. The photo of the Mehdi Army hanging Hussein in effigy is pure propaganda. The photo will do several things. It will lead to the deaths of more of our brave soldiers and it is used as a propaganda tool to hide the fact the Mehdi Army is a Sunni Army is Shiite clothing. You can go to the bank knowing al-Sadr is protected by the US military. Shiites need to kill al-Sadr yesterday and bring this Sunni in Shiite clothing scam to an abrupt halt. The Mehdi Army is a very dangerous and serious problem for Shiites. The Mehdi Army is a false operation. The Mehdi Army is the excuse for the US military to kill Shiites. If Shiites do not kill al-Sadr and expose the Mehdi Army as a false flag operation of Sunni in Shiite clothing Shiites are fixing to be slaughtered much worse by a Neocon led USA military than Shiites were ever slaughtered by Saddam Hussein. Shiites are depending more and more on the Mehdi Army for protection, but all Shiites are doing is letting wolves in the henhouses.

NAJAF, Iraq, Dec 28 (Reuters) - Iraqi officials in the city of Najaf said on Thursday that a raid which killed a top aide of Shi'ite cleric Moqtada al-Sadr was a violation of the deal that transferred U.S. control of Najaf to the Iraqi army.

Less than 10 days after the U.S. military handed control of Najaf to Iraqi forces, U.S. military spokesman Major General William Caldwell told reporters that a U.S. soldier killed Saheb al-Amiri in a raid planned and carried out by Iraqi forces.

 



Report: U.S. frees 2 Iranian detainees

TEHRAN, Iran (AP) — Two Iranian diplomats detained by U.S. troops in Iraq were released early Friday in Baghdad, Iran's state-run television and news agency reported.
The Iranians were in Iraq on the invitation of Iraqi President Jalal Talabani, officials have said. Their detention was announced on Monday.

The two were handed over to Iranian officials in the presence of Iraq's National Security Adviser Mouwafak al-Rubaie, Iran's state-run news agency, IRNA, reported.

Hassan Kazemi Qomi, Iran's ambassador to Baghdad, said the arrest of the two diplomats was against internationally accepted regulations, IRNA said.

"Fortunately with the effort exerted by the Iraqi officials, the U.S. forces, who first denied their arrest, were obliged to admit it and under pressure from the Iraqi government to release them," IRNA quoted Qomi as saying. Iran did not provide any more information about the diplomats and their release.

The U.S. military and the U.S. Embassy in Iraq said they could not immediately comment.

BAGHDAD, Dec. 29 -- Two senior Iranian operatives who were detained by U.S. forces in Iraq and were strongly suspected of planning attacks against American military forces and Iraqi targets were expelled to Iran on Friday, according to U.S. and Iraqi officials.

The decision to free the men was made by the Iraqi government and has angered U.S. military officials who say the operatives were seeking to foment instability here.

"These are really serious people," said one U.S. defense official, speaking on condition of anonymity. "They were the target of a very focused raid based on intelligence, and it would be hard for one to believe that their activities weren't endorsed by the Iranian government. It's a situation that is obviously troubling."

One of the commanders, identified by officials simply as Chizari, was the third-highest-ranking official of the Iranian Revolutionary Guards' al-Quds Brigade, the unit most active in aiding, arming and training groups outside Iran, including Hezbollah and Islamic Jihad, U.S. officials said. The other commander was described as equally significant to Iran's support of foreign militaries but not as high-ranking.

It tells us something is brewing with nukes and subs. Since the USS Memphis nuked the Kursk there is bad sub blood between the USA and Russia.

Two die as crewmen are swept from US nuclear submarine

PLYMOUTH Two crewmen from an American nuclear submarine died after they were swept overboard as the vessel was leaving the naval dockyard at Plymouth.
Four members of the USS Minneapolis St Paul, were hit by a wave as the boat was manoeuvring out of the Devonport docks.

The men were all tethered with safety ropes, but the rough seas and high winds made it impossible to haul them back on board.

A rescue helicopter from RNAS Culdrose, a tug and the Plymouth lifeboat were all sent to the men’s aid, along with police launches, as the submariners were pulled alongside the 110m (362ft) vessel, being battered by the waves.

Ambulances were waiting on the dockside when the men were eventually brought ashore, but two were pronounced dead on arrival at Derriford Hospital, Plymouth. The other two men were treated and released. The submarine was riding at anchor last night.
